1. What concessions are available for the disabled in importing a car?

Under the Customs Law (State Gazette of the Republic of Serbia, No. 73/03 or 61/05) persons with disability of at least 70% are entitled to import a car without payment of customs duty. The qualification for refund of VAT is somewhat more severe. In order for a person to be entitled to a refund of VAT they must be 100% disabled, not cumulatively but only on one count.

2. May a car which has been imported by a disabled person taking advantage of this concession be driven by a person who is not registered at the same address as the person importing the car?

Cars which are imported free of customs duty may only be driven by close family members and carers, but if the disabled person is present then they may be driven by persons other than family members.

3. In cases where a care and assistance allowance is received is it also possible for the same person to receive a disability pension or is it legally impossible for the same person to receive a care and assistance allowance and a disability pension at the same time?

The right to receipt of care and assistance allowance is given to insured persons and pensioners, which means that there is no restriction on them being in receipt of care and assistance allowances and disability pensions at the same time.

4. How long may a mother of a child that needs special care be absent from work?

Either of the parents of a child that needs special care due to a high level of physical or mental impairment has the right at the end of the statutory period of maternity leave and childcare leave to be absent from work or to work half-time up to the child’s 5th birthday.

5. Who is entitled to disability pension?

The right to an disability pension is given to any insured person who completely loses the ability to work, if the disability is caused by a work injury or a work-related illness, or is caused by an injury or illness outside of work, on condition that the loss of ability to work arose before the person attained pensionable age and has made contributions for at least 5 years.

6. How can a person under 30 years of age obtain a disability pension?

If it is a question of a person whose disability is cause by illness, or by an injury outside of work which arose before the 30th birthday, he or she is entitled to a disability pension in the following circumstances:

  • Where the disability arose before the 20th birthday, one year’s contributions are required;

  • Where the disability arose before the 25th birthday, at least two years’ insurance contributions must have been made; and

  • Where the disability arose before the 30th birthday, at least three years’ insurance contributions must have been made.
